    My question involves name change laws in the State of: Florida

    When my child is born, if the father is not present at birth, can I still give my child his last name?
    Our fist 2 have his last name and I'd like to keep it this way for this one too even if he is not present at birth.

    Can I do this?

    Yes, you can give your child whatever last name you choose, the father does not have to be present.

    However, unless Dad is present to sign the AOP, or you are married, you will not be able to list a father on the BC. Then later, once paternity has been legally established you can have the BC amended to show the father.
