    Non-Biological Father Name Change
    My question involves name change laws in the State of: California
    The person listed on the birth certificate is not the bio-logical father. I want to prove this in court because he threatend to TAKE my 2 year old daughter. She currently has his last name big mistake, Me being too nice. Once the DNA proves he is NOT the father, do I still need his permission to change her name and can I then remove him from the birth certificate and be done with this mistake once and for all.

    Did this man sign the AOP? If he is NOT the father, why did you allow him to sign the AOP?

    Have you started a paternity case yet (paternity, not child support)? There is a part in the petition to establish paternity to ask for a name change of the child. Make sure that information is filled out.

    HOWEVER, did you allow this man to sign the Declaration of Paternity?
