Information About Charges and Sentencing
My question involves criminal law for the state of: Colorado
A cousin was yesterday arrested and charged for 2nd degree assault, they were in a New years party and his best friends girlfriend was raped, my cousin and his friend stating to look for the guy who did it. Once they found him they beat him and sent him to the hospital. now all of them are in jail waiting for the judge to determine the bail. But even if we pay the bail, can they be sentenced to jail and for how long?
They are tourists, students in my country, they went to US only to work during their vacation, but they´re suppoused to come back yo school in March.
Can the fact of that they were mad because what happend to the girlfriend help them?
Please, they are by themselves there and we don´t know what to do from here.

Well, they're not getting a bond unless the judge is an idiot. They're a huge flight risk.
If they beat him up bad enough to put him in the hospital, they could be facing prison time followed by a deportation order so they'd never be able to return to the US. What were the injuries, and what weapons or objects did they use to beat the guy up.
Them being mad is motive that helps the state prove it's case, it's not a mitigating circumstance.
I don't have a moral problem with revenge attacks on rapists, but if you do it you have to be ready to deal with the consequences.
