Grand Larceny Charge

My question involves criminal law for the state of NewYork a few days ago i was arrested for grand larceny in the 4th, i was pulled over and was told that i have a warrant for my arrest , after the cuffs were put on me , and taken in , i was never read my rights , now i am on probation, my probation told me that i will have to go in front of the judge because i am on probation ..... now this arrest for grand larceny in the 4th , i have no clue what this is about , the day that they said it happened i was with my loved one . and i have proof that i was with someone , they said that i was seen on video that i was at another place.... also my bail was $ 5000-- and i am out on a $ 500 bond ......... someone please help me ................... what is the most time i can do for this ........:(

The issue here is NOT how much jail time you can get for this but how much jail time you can get with this along with your probation violation.

You do not mention what you are on probation for so I can not even guess at this point.

A new charge such as this would also be cause for a probation violation. This is more then just having to appear before a judge.

If you have proof you didn't do it, then why would you think you'd get time? You only serve time when the state can prove to a jury that you committed a crime or you plead out because you were caught dead to rights.

Now in this case you have the issue of your probation revocation. I'd go hire a lawyer (unless NY grants it as a state right, you don't have a right to an appointed lawyer for a probation revocation). Let him know about your alibi, and let her work it out.

Working out the probation revocation is the key. That's what people generally get time for. Also the burden of proof is lower, so if you beat the revocation, the state should understand that you'll beat them at trial.
