19 Year Old Intending to Go Back to School - Used to Receive SSI
Hi to all, My ques is about a 19yo step-son. His father (my deceased husband) died 2 years ago, he used to receive SSI till he turned 18yo and quit going back to school/college. Me and my 3 kids are still receiving SSI. My ques is should in case he goes back to school even part-time or full-time or go to college next year, will he still gets SSI back and deminish our benefit then? I am concern and confuse on this once he decides to go back to school/college. I thought SSA has some rules pertaining to this issue...

    Thanks very much...

Here is a link regarding benefits for your stepson with the rules. It depends on when his benefits ended and you should talk to your ssi case worker to find out if he has any benefits left that he would qualify for.
    http://ssa.gov/pubs/10085.html

If that turns up to be a bust, have your stepson apply for financial aid for school. Start by going here: www.fafsa.ed.gov
He should be able to get a good portion of school paid for.
    Good Luck.

Thanks gigirle for responding. I was reading the SSA link you furnished me. Actually, I really do not want him to get anything from my and my 3 kids' SSI. Per SSA website, 18 yrs or below still in elementary 12th gr can continue to get his/her benefits. His benefit ended when he turned 18yo when he graduated in High School last year.

Now per my understanding, he is not entitled anymore SSI now that he is 19yo and I do not think he plans to go to college full-time cuz he is working too at the same time....

    Thanks.

He was NOT getting SSI based on a deceased father and neither are the other children. SSI stands for Supplemental Security Income and it is not funded by FICA/OASDI payroll taxes, it is a needs-based program for disabled low income adults and disabled low income children and elderly low income adults (over age 65).

What the children get is Social Security Survivor benefits. I know that the words and acronyms are very similar and easily confused. Survivor benefits are not needs based. Children with massive trust funds and wealthy surviving parents can get Social Security Survivor benefits if the deaceased parent paid into the Social Security system for enough years by paying FICA/OASDI taxes.

Children's survivor benefits end when the child reaches age 18 UNLESS the child is still in high school on his 18th birthday. Then, the benefits continue until he is out of high school or turns 19, whichever is first. Decades ago there were survivor benefits for college students. Not now.
