Emancipation Within Illinois
I realize that emancipation is allowed under rare circumstances, including such that an individual can independently support themselves. My situation is that I'm a 17 year old, in Illinois. I am working part time, however I just started two months ago so I am lacking long-time work history. I have arranged for early graduation and taken the necessary courses thus allowing me to work full time upon graduation in mid January. Currently I live with my parent, but rarely see her. She is rather erratic in her desire to move, this being her 15th or so move since I was born. We moved to Illinois in '07 and I will just be receiving my residency come '09 for college.My dilemna is that she is moving out of state within the next few months, and I wish to remain in state for college. However due to age, I have to move with her, thus losing my instate residency and almost tripling tuition fees. I have money saved up as well as a set budget and possible living arrangements set however I need to be either emancipated or 18 to enter into a contract of renting an apartment. I have the recommendations of both school staff and my boss.
The catch 22 of the emancipation of minors that I noticed while looking into it was that an individual must prove they are capable of supporting themselves and are living independently, yet for me it is impossible to enter into a contract to live independently without being emancipated. Any suggestions or feedback? I was consideirng the possibility of paying partial rent to my parent. Would this be a valid case or would I have any chance of getting emancipation?

Among the other facts you must establish to emancipate, you must show to the court's satisfaction that you are "a mature minor who has demonstrated the ability and capacity to manage his own affairs or (ii) a homeless minor who is located in this State; and [that you have] lived wholly or partially independent of his parents or guardian."
You seem to believe that the Illinois statute is designed to help you move out against your parents' wishes, whereas its language suggests that it's there to offer relief to minors who are already supporting themselves independently, or minors who are homeless. Try to get mom's permission and support for your living in Illinois, in a safe, appropriate environment, until you start college.
