Teen Charged With Possession With Intent to Sell
My question involves criminal law for the state of: California

I have a case in which a 17yr old was charged with Intent to sell on December 28,2008. The driver was outside of the car, and a little bit later he notices a cop outside searching his car. There he finds two of his friends being busted; one carrying cocaine, the other carrying a big marijuana bag(Prob less than an ounce) and a scale. The driver got off of the cocaine charge because the actual carrier claimed it. The person who was carrying the marijuana, however, did not. Now the driver is facing Possesion of marijuana with intent to sell. We have the contact of the actual guy, and he is a "friend" of the accused.
We can also get him to claim both the scale and the marijuana.

What should we make of his case since he was the driver? What should we expect the prosecutor to do?

What measures should we take prior to getting a lawyer?(What should we have ready to say/give to the lawyer for a strong case)

Is it probable that his charges can be dismissed with the actual guy confessing?

I appreciate your feedback. Any opinions, hard or soft,

None. Get a lawyer before taking any measures.

The lawyer will ask questions; your friend will answer them. That will help the lawyer build the case.

It improves the odds. Your friend will want to discuss that with his lawyer.
