Paternity Rescission Form
My question involves paternity law for the State of: California
I just looked up what I have to do to get the non-biological father off the birth certificate and it says that I have to get a signed certified return receipt. Does that mean I need to have the non-biological father sign that he got the mail? Or is that signed from the mail company? What if he won't sign it?

He has to sign that he got the letter.
Take the letter directly to the Post Office to mail. Tell them you want it certified, return receipt, and they will attach a little green card to it that he will have to sign, then the Post Office will send to you.
Save that green card.

What should I do if he doesn't sign it? I mean if he isn't home when the mail gets there?

First of all, why are YOU doing the work to get the non-bio dad off the birth certificate? You can begin child support proceedings with the CA State Dept of Child Support. Once that process begins, then he will do anything to get his name off the birth certificate.
