    No Contact Until Three Years After Repo
    My question involves an auto loan or repossession in the State of: PA

    Hello...I had a vehicle repossessed 3yrs. ago...never received any information from the bank..nothing since the night that they took the car. Until now...yesterday I recieved a letter from a lawyer that stated "despite our previous communication, you have yet to pay the debt owed to my client, hence we are commencing legal action against you" I nver spoke to this attorney, or ANYONE regarding the repossession. I nver received any notification of when it was being sold, if it was ever sold, etc. What action should I take? They are attempting to collect 11,000 from me.

    Did you move after the repo and not leave a forwarding address? If so, that would explain why you never received notice. Nonetheless, they are suing you for the balance owed after the sale (owed on loan - sold for), plus most likely legal fees, interest, etc.

    You should consult with an attorney to see what, if any options, you may have available. If they sue and win, they could garnish your wages, your bank account(s), place leins on your property, etc.

    You might check with your state's UCC if indeed the state of PA observes the UCC. (Uniform Commercial Code) You mention that you never received notification of sale. Are you saying that you never received any written communications from the OC (Original Creditor) concerning the repossession and sale of your vehicle? If you haven't moved, then you should have received a Notice of Disposition after the repossession of your vehicle.

    Check with your State's UCC - Chapter 9 and see what is covered regarding secured transactions.

    I am not a lawyer so the information above is what I have discovered from research and lots of reading. Check with your state's repossession laws and the UCC if your state recognizes the UCC.
