    I was outside of a store a while ago, and the cops ended up comming because a report had been called in that my friend and I were stumbling into people and objects. We then got arrested for public intox. I have anothr thread with other details about shoplifting on here, but I am just asking about the public intox. charge. The police did not see any of us doing anything disorderly, did not give us any kind of sobriety tests, only smelled some alcohol on us. The local police log in the paper says that just my friend was seen stumbling into clothes racks and that was what bought this whole thing on. And the cop wrote on my ticket... public drunk, but the reciept for the bail says public disorderly condcut. Do I have any argument here? Thanks for any help. Oh, I also don't want to go into court saying I am not guity, be found guilty of public drunk... or disorderly counduct, and be done worse then if just said to be guilty of the bat. Like said, my name is not mentioned anywhere in the police log, does this mean anything?

    A "disorderly conduct" statute or ordinance will often subsume the offense of public drunkenness. A modern "disorderly conduct" law typically lists a number of public actions which can trigger prosecution, including drunkenness.
