    Sentence Reduction Once on Parole
    My question involves criminal law for the state of: Texas
    I want to file for a reduction in sentence, there are circumstance in my case which I know will grant me a reduction. My problem is that this must go before the court which sentenced you. There is only one judge in this court and he WILL NOT give me one. I know this as there are personal reasons why he sentenced me in the first place. Anyway. Once he denies my reduction can it be appealed to a higher court and out of his control? An appeal was never filed by fault of my attorney at the time, and I filed a habeus which they say "never" made it to them. I bid my time till I made parole, now after 2 years out I want to finally put this behind me and get on with life. I know that once all legal issues are presented to another this will happen. Only if I can appeal though. Is there hope?

    Knowing nothing about your case other than your belief that the judge won't give you a cut in your sentence, all we can really do is suggest you consult a new lawyer and share the specifics of your situation. Generally speaking, an appellate court isn't going to disturb the discretion of the sentencing court in relation to cutting a lawful sentence.
