    Criminal Attempt, First Degree Murder
    My friend is charged with this crime. He has not been convicted. These are only allegations. A person states that my friend was shooting at him on 2 separate occasions. Nothing was hit. No one was injured. My friend has 2 agg. assault + 1 criminal attempt first degree murder charges. He has been in jail for 8 months and on February 1st, these charges will either be dismissed or set for trial. 0 evidence, only allegations. He already has an attorney. We are worried because this happens a lot in TN. All you have to do is go downtown with your allegation and the person will be locked up with no questions asked. No one has come to my friend (no detective/noone) and asked him anything about where he was when this allegedly took place. He just found out he had a warrant and turned himself in and then found out that it was for these allegations. My question is how does criminal attempt first degree murder factor into all of this if noone was hurt or went to the hospital or anything? The police report states that there were no injuries to anyone.

    I find it curious that you are emphasizing "nobody got hit" rather than "my friend didn't shoot at the victim". If the bullets hit, the odds go up that the conviction will be for murder, rather than attempted murder.

    In my past posts I have emphasized that my friend didn't do this. I know he didn't because we were together. His sisters boyfriend is trying to avoid conviction for stabbing him and this is why he went downtown and said this. I am speaking of what the reports say because the fact that my friend didn't do this appears to be irrelevant at this point since he has been in jail for the past 8 months. When you are an african american felon in TN, It really doesn't matter whether I say he wasn't there or not. If it was that simple, he wouldn't be locked up, would he? What we have before us is an 'allegation' and whether you believe how I'm wording this is ok or not, it still doesn't change the fact that my friend is in jail for something he didn't do or the fact that what the 'allegation' says is that noone got hit. I need your good knowledge and information, not for you to be judgemental about the way I am wording my post. I post under the name MICHELL and if you are going to be judgemental, I would appreciate if you would allow Aaron to answer as he has in the past. Thanks.
