Going After Custody

My question involves a child custody case from the State of: Michigan?

I want to go after custody of my son. Currently, I am married to his Canadian mother. My son was born in Canada and has dual citizenship. I obtained his US citizenship immediately. Neither one of us has custody. We are all residing in Canada although my papers for residency have not been completed. We were married in Michigan but not in Canada. How do I go about this? Do I need to start paperwork in Canada or can I do it in Michigan, where we will be residing? I'm positive I can do the divorce in Michigan.

You an get a divorce in Michigan once you establish residency but, as that's where the child resides, Canada has jurisdiction over custody issues and you should presently expect to have to litigate the custody, support and visitation issues in Canada.

Your statement, of course, is ambiguous. When you write "where we will be residing", if you mean that the family will be relocating to Michigan prior to your filing for divorce, you can wait for Michigan to have jurisdiction over custody and support issues before you file.

Is the mother going to contest the move to the states??
