    Polaris ATV Hit on Private Road
    My question involves insurance law for the state of: Michigan

    My son was driving with his young daughter on his Polaris ATV( looks like a golf cart on steriods). The area they live in has private roads and allow these vehicles on the road, speed limit is 25mph. The road was snow covered, a truck came around a curve out of control and hit them. Lots of damage to his ATV, he does not have insurance on this. Is the driver of the truck responsible for any damages other than the possible 500.00 from his insurance. Thank you for any information or suggestions, the ATV was worth about 9000.00.

    Not positive of this but I do not believe the no-fault insurance limitations apply since the ATV is not considered to be a motor vehicle and subject to the no-fault insurance requirement. I believe it would become a matter of who is at fault with that person bearing liability.
