    Unmarried couple terminating relationship/div of home equity
    What specific monetary contributions are considered when factoring who gets what percentage of the home equity?
    Down payments from each person? Who paid what towards mortgage? Who took the tax deductions? Who paid the utilities? etc I want to get my records in order for mediation or negotiation of the equity and this information will be helpful.

    Both parties are on the title?

    By way of settlement, you can agree to whatever you want. Absent a contract or a clear, provable understanding, there is a chance that a court would simply split the equity.

    With joint property, there is normally a presumption of equal ownership. The party who is seeking a greater share, assuming they cant reach an agreement, would have to convince a court that equal ownership was not intended, and document the extent to which they should be favored in the division of the equity.
