Marijuana and Trespassing Charges in Texas
My question involves criminal law for the state of: TEXAS
Recently I was charged with possession of marijuana (under 2 grams) and criminal trespassing. I also got 2 citations, for minor in consumption and paraphernalia. I'm 17 and this is my first offense... so basically these are my questions:
1. What kind of sentence am I looking at?
2. Is there any way I can get these dismissed?
(The cops did NOT tell me my rights or anything when I was arrested, they searched my bag without asking, and they charged me with consumption without actually asking if I drank/whether my parents had given me the alcohol. I'm also really confused as to how the cops could press charges for trespassing on private property, wouldn't it have to be the owner?)
Please answer, I don't know what to do...

Your looking at whatever sentence the judge feels is justified by your record, up to the maximum sentence for the charge. With no prior record, I would expect fines and probation, and perhaps community service.
There may be a way to get a deferral, or to try to suppress the evidence being used against you. But you know what? You possess marijuana if you possess it, even if you're not smoking it. You possess paraphernalia if you possess it, even if you're not using it. You possess alcohol if you possess it, even if you're not drinking it, and even if you got it from your parents. You're trespassing on private property if you're trespassing; if the owner gave you permission to be there, be sure to prove that to the prosecutor.
