    Ticket Buyer Wants a Refund
My question involves a consumer law issue in the State of: Washington

    Here is what happened:

I posted tickets for friend on our work 'ticket distribution list.' A girl indicated via email she wanted to buy them. She brought me a check and I emailed her the tickets. Three days later she came to me and said she didn't think she could go and could i try to resell them. I said I will try but I didn't think I could because there were so many for sale and it was last minute. I posted the tickets again. That night she emailed me asking if the tickets had sold and I told her no. She never returned or offered to return the tickets. The tickets did not end up selling at all so I cashed her check.

3 weeks later she emailed me asking why I cashed her check because she returned the tickets saying she couldn't go.

I don't believe I owe her money as she clearly indicated she was still somewhat responsible for them by asking if i'd found a buyer...she bought them from me and never returned them so in essence she has ownership of them.

My question is do I legally need to give her money back?

first, I have to know how you e-mail tickets for a performance?

from what you have posted, no, you owe her nothing. She bought the tickets. She did not return, or even attempt to return the tickets, by your info.

By your statements, she was not returning the tickets to you but asking you to attempt to resell them. They are hers and the money is yours. End of story.

thanks JK...some tickets for the football games are in pdf format so they are easily emailed. Appreciate your response.

dang am I getting old. Never heard of such before.

so a question to you folks with the knowldge of this:

what prevents a person from selling the same ticket 47 times.. Sure, they could sue but how do they decide who is the rightful owner when those 47 people show up and all claim the seat it theirs?

    Re: Who is Right Here
unfortunately nothing stops them from doing that. Usually only season ticket holders have these types of tickets and their name is on them. When they sell them they can enter the buyers name so it appears on the tickets. If the person that bought them tries to sell them they can, but they can't change the name that is on them. So...if 47 people showed up with the same tickets and one of them had their name on them they would get the seats. If not I guess they duke it out :)
