Re: Is It Really Pedophilia
It is illegal for you to have sexual contact with this man
Re: Is It Really Pedophilia
But why? I mean, look at this:
(1) A person 24 years of age or older who engages in sexual activity with a person 16 or 17 years of age commits a felony of the second degree, punishable as provided in s. 775.082, s. 775.083, or s. 775.084. As used in this section, "sexual activity" means oral, anal, or vaginal penetration by, or union with, the sexual organ of another; however, sexual activity does not include an act done for a bona fide medical purpose.
(2) The provisions of this section do not apply to a person 16 or 17 years of age who has had the disabilities of nonage removed under chapter 743.
(3) The victim's prior sexual conduct is not a relevant issue in a prosecution under this section.
(4) If an offense under this section directly results in the victim giving birth to a child, paternity of that child shall be established as described in chapter 742. If it is determined that the offender is the father of the child, the offender must pay child support pursuant to the child support guidelines described in chapter 61.
It says there that anybody over 25 isn't allowed to have sex with me. He's not 26+, so it should be fine...?
Re: Is It Really Pedophilia
There is a member of this site whose 19 year old son got 12 years for exact samething in same state! FL age of consent is 18!!
Re: Is It Really Pedophilia
You know when you were instructed to identify your state, because laws are different in each state? That's because nobody can know the laws of your state unless we know what state's involved.
If you want to know the age of consent for your state, your inquiry begins and ends here.
If you want to know the definition of pedophilia, a dictionary is a good place to start.
Re: Is It Really Pedophilia
OP location (top right) is FL so I used FL as likely state. Age of consent in FL is 18. We also have a FL member here whose 19 year son got 12 years for same offense as OP desribes (sex with a minor age 16 I believe)
Re: Is It Really Pedophilia
it's actually called Ephebophilia. There is a legal distinction between a child and an adolesant, a child being 0-14 Either way it's a felony.
Ephebophilia
n. a sexual preference in which an adult is primarily or exclusively sexually attracted to postpubescent adolescents

Actually, what it says there is no one aged 24 or over may have sex with you.
There is a "close in age" exemption in Florida - which is what you cite.
HOWEVER - the legal age of consent in Florida is 18. If your parents wanted to have the fella put up on statutory rape charges, they could, and the charges would likely stick.
Re: Is It Really Pedophilia
No one on the boards (this board at least) can tell you whether or not it is legal. Aaron has a stickie on that topic: http://www.expertlaw.com/forums/showthread.php?t=25899
What I can tell you is if you really like this guy then you can wait until you are 18 to have sex with him and you are both in a situation where you can legally consent to sex or sexual relations. If you really care for him you won't do anything with him that will land him in prison. Funny guys quickly lose their audience who thinks they are funny when they are in prison for statutory. Even a contributing to the delinquency of a minor charge can have serious consequences. ...and when he gets picked up for that and they check his phone he better hope that there are no questionable pictures (you in your skimpies or you topless) of you stored on it. You are a minor and that's child pornography even if he recieved it.
...and don't cross a state line to have sex in a state where it's legal. That's a Felony. That's not a *wink* *wink* piece of advice so that you can get around the law*wink* *wink*. That's a *wink* *wink* piece of advice to keep him out of prison and keep him from getting charged with a Felony. Look up the Mann Act for more info.
Your hormones are raging, his are raging, you are both teens and only 3 years apart. ...but you have to wait until he is 21 and you are 18. It doesn't seem fair because it's just 3 years but those are the laws and they are passed to protect you. Yes, other states have Romeo laws. Florida is pretty tough on sex offenders.
In addition I wanted to mention that your parents and his parents could be 100% cool with it BUT someone could mention it to an adult in a position of trust, such as a guidance counselor. In that instance he is toast. Your parent's can't consent to him committing a Felony with their minor child.
Re: Is It Really Pedophilia
Oh, I see. Ah, that really sucks then. =/ I mean, I could wait, I don't mind that, but still, y'know? I think he was really looking forward to it (and I won't lie, I was too, haha), but I guess we can wait, y'know? :)
Haha, Bran. That's pretty funny. -- Yeah, I understand that whole little thing with our hormones and all that, but I mean I guess we can control ourselves. We're both actually pretty mature for our ages (or so I'd like to think), so I'd think we could hold it off for another... *gulp* Two years... @_@"
