    Sealing and Expungement in Dallas
    I was recently arrested on PI charge in Dallas. If I receive deferred adjudication, can I ask my charge to be sealed myself? If sealed, can employers view this charge? At the time of expungement, can I do this process myself or do I have to go through a lawyer? This is my first criminal offense. Thank You.

    You can ask the court clerk where you were charged if they require an attorney to file for a non-disclosure (this is the petition that seals your record) or if you an do it yourself. Typically, you are permitted to do it yourself but court rules vary. The process is generally that you have to draft and file a petition and order, appear at the hearing and persuade the court that you qualify for a non-disclosure, if granted then you have to make sure that the appropriate state agencies follow through and seal your record, and you have to notify possibly private entities that have obtained your record to be sure they seal it too. When drafting the petition, be sure to follow the exact requirements (ask the clerk where to get them) else it can be fatal to your request.

    There are exceptions (ie: schools, hospitals, licensing agencies, fire departments, etc.) as to which employers can view a sealed record, but typically, most cannot.
