Can My Roommate Kick Me Out Tomorrow

My question involves a roommate in the State of: Illinois

ok here is the situation, my roommate wants me gone tomorrow, she has told me 2 weeks ago that she wants me out asap (shes accusing me of all sorts of crap and is crazy and didn't like me to begin with)...I am on disability and my check comes on the 3rd, which is wednesday, I told her before she told me she wanted me out that I was leaving on the 3rd, she said ok, I cannot move any earlier since i have nowhere to go, and i absolutely HAVE to have my check on the 3rd because i will be moving across country that same day!....i am worried that she will kick me out with no place to go and that she will withhold my check from me and say it never came...she has gotten really nasty with yelling at me all the time more so then normal and i am afraid she might try to physically remove me from her house...

here are the facts, she owns the home

we have a contract that is POORLY written out and states word for word: I, (insert my name here), agree to pay $320 (three-hundred twenty dollars) the 3rd (third) of every month beginning November 3, 2008 to (insert psycho roommates name here)....and that's it...then i sign my name at the bottom.

this lease i can guess means nothing since it is so poorly arranged "shrugs" don't know if that helps anything at all....

I moved in on october 16th?...i offered her half months rent, she said it was ok and i didn't have to do that.....so officially i moved on on november 3rd....and she wants me gone before the the rent is even due...

I plan on keeping my house keys in pocket and cellphone too just in case she does decide to go crazy on me...I am sure the poo is going to hit the fan and authorities will be called...going to get really nasty i bet.

Poorly worded as it is, you do have a lease agreement, so she's stuck having to give you formal notice that she wants to terminate the tenancy, and she'll have to file formal eviction proceedings if you refuse to leave.

Information about Illinois eviction is here. Sounds like you have a month-to-month agreement, so she needs to start with a 30 day notice.

well it happened, she called the cops, they told her what i told her about about her having to obtain a 30 day notice, she got ticked and went crazy on me and started throwing my things around and out of the house and harassing me....called the sheriff and set things straight....it worked, hopefully she doesn't go totally psycho and try to murder me in my sleep or something lol
