Can She Sue Me for Alienation of Affection
My question involves alienation of affection law for the State of: North Carolina
I am married and had an affair w/a married man for 10 yrs. He and I came clean and told our spouses about the affair several mths ago. My spouse and I are working on fixing our marriage and so is the man I had the affair w/ and his wife. He and I have had no contact since our confession. I also found out that he has had more than 5 other affairs (one during the time that I was seeing him) during his marriage to his wife.
His wife is very vendictive and is threathening to sue me for alienation of affection even though she and her husband are still together and are working on fixing their marriage. The affair began by him pursuing me. My husband and I just want them to go away and leave us alone so that we can fix our marriage.
Does she still have the right to sue me since her husband has had so many affairs during their marriage, plus he pursued me?
Re: Can She Sue Me for Alienation of Affection
In order for her to get anywhere with an alienation of affection claim against you, she would have to show that:
-- they were happily married and shared genuine affection
-- YOU maliciously interfered and caused the loss of affection and breakdown of the marriage.
Given that he had multiple other paramours and he was the one who ran off in hot pursuit, she's not going to get very far with that.
