Health Insurance Not Paid Despite Divorce Judgment
My question involves divorce in the State of: New York
Hey, my parents got divorced in NY over a decade ago, my mom was supposed to get her health insurance paid for for life and for whatever reason let it slide because my dad made it difficult and never paid it. She lives in illinois now and he's in california. From what I know there are other details that she let slide as well and isn't in a good position anymore to not have that assistance. What options does she have, she's a bit crazy at this point and i'm trying to help her work through this and get all the details but I know absolutely nothing so this is where i'm starting. All I know is because the divorce took place in another state and now both parties don't live in that state but separate states it's been difficult for her to get a lawyer to deal with this. Thanks.
Re: Health Insurance Not Paid Despite Divorce Judgment
It's going to be complicated and costly to enforce the judgment given the interstate aspects. It may require lawyers both in the state where the judgment was issued and in the state where your father currently lives. With your mother being "a bit crazy", it may also be necessary for her to have a guardian appointed to protect her interests.
I suggest starting by having a lawyer, licensed in New York, review the judgment and tell you what a court is likely to do if the issue of enforcement is raised. Then you would need to start looking into interstate enforcement.
