    My question involves collection proceedings in the State of: ny

    im new to this site so sorry for any mistakes. 4 years ago i received a credit card bill from bank of america for 1300.00 dollars I never applied for nor recieved a card from them. I contacted them and the sent me a affidavit to sign, did that and sent it back but never followed up on it now i have a levy on my checking account for 9,800.00 from NCO. I called their attorney and requested documentation for the debt and that they served me to appear in court and first they said it will take 120-160 days then they said they do not have to provide me with documentation because they already have a judgement. can they do this and if the original amount was 1300 can they legally charge 9800 now?

    It seems they got a default judgment against you. You might contact the court to see when & to whom the summons to court got served to.

    The additional amount is probably interest which can be collected on a past due account.
