Rights on Monetary Assets
My question involves divorce in the State of: Virginia.
Hello Experts..
I 'm a rookie to this..Pls help....
I was living with my wife only for 5 months before we got separated. Now, after the 'required separation' time, I am filing for divorce in VA. Now, my wife is a graduate in Computer Engineering and had worked as a lecturer in a college before marriage but did not work after marriage.
1. How will the alimony/maintenance be decided if she tries to claim that She 'cannot' work ?
2. What rights does she have on my car and bank accounts that I acquired before marriage(nothing is in joint names)?
3. Do I need to give her 50% of what I have right now ?
Pls give your valuable guidance on how to proceed/plan for this... Thanks

For this short of a marriage it is normal for both of you to jsut go your separate ways. However, if she balks, it will be in your best interest to pay her something in return for a settlement agreement. Cheaper than lots of attorney fees.

Thanks for your advice lwpat...I wish She is ready for a mature discussion as you suggest... I hear she is aggressive to cause damage to me as much if I divorce her...Neither of us have had much of the pleasure during the time together, however, looks like the sense of revenge/hatred comes out of the feeling of rejection in such legal move....
Hence, I need to know what is, by law, required so that I am not fooled by the people/situation....Pls help as much...Thanks

The best thing for you to do is to hire an attorney. Laws vary by state but someone that knows what the local judge is likely to do is your best resource.
