    Maternal Rights Regarding Paternity
    My question involves paternity law for the State of: WI

    I would like to know what my rights are as an expectant mother regarding paternity testing being requested by a third party.

    My husband and I have been married for 11 years and were separated for a short time earlier this year. During that time we were both involved with other people. We were able to work out our differences and reconcile. Upon reconciling I found out I was pregnant. Based on appointments and dates of conception we are optomistic that he is the biological father and will raise this child as such.

    The other gentleman knows I am pregnant. He wants to know if he is the father, yet has mentioned he will give up all paternal rights if he is. My husband and I do not want anything from him other than to be left alone. We have made it perfectly clear what our intentions are as the expectant parents of this child, yet he continues to harass me.

    If he petitions the courts for a paternity test, what rights do my husband and I have?

    If he petitions the court for a paternity test, then it will be up to the judge as to whether or not the judge will order one. At this point, the child has a legal father, although it would be nice of you to submit to one willingly.
