Change of Children's Last Name
My question involves name change laws in the State of: PA
Im interested in changing my daughter's and son's last name. But there is only one difference in changing my sons last name and changing my daughter's.
My daughter has her "donor's" last name. He doesnt pay child support the only time he pays it is when he gets locked up. He currently has a warrant for not paying. He has a daughter previous to mine and does not pay child support for her nor does he visit either of them (mine or his prior). He does not have no interest in seeing them although every time I ask him if he will be willing to change it he gives me a hard time and acts like he cares about her.
Now for my son. I never put a fathers name on his birth certificate or paternity forms. Although my fiance who I just had my 3rd child with has been paying childsupport for my son. He actually has been raising my daughter and my son with me no questions asked. The recognize him as their father and always will because he is the one who has been there for them in every way they needed and still need him. Now we have our official biological child together and Im I want all my children to have the same last name because we are looking into getting married soon. My child I just had has my last name and her fathers last name also (we hyphinated it), my son (who has no father on his records) has my last name so Im just interested in hyphinating his name to add my fiance's name to his, but my daughter has her donors name so I need a whole last name change for her.
How do I go about getting information on how to go about changing their last names and what are the requirements? How much will it cost me?

If you want to change the name of the children, you will need their father's approval.

Well it said to get a reply i should post a reply on my own so someone will see it if there are no replies most people will not look at it.

If you want to change the name of your children, you will have to get the father's permission.
I realize the Christmas season is approaching, but I assure you that the boy has a father as well as a mother.

Your situation is a little complicated since there are 2 fathers, you really should get a consult with a local attorney to find out exactly what steps you need to take in each situation. It will be well worth the cost of the consult.

Because he isn't listed on the "paperwork" doesn't mean he doesn't exist. You will need to establish paternity. Period.

You don't need to legally establish paternity before accomplishing a name change. Expect that the court will require notice to the putative (presumed) father. What he does after he gets that notice - challenge the name change, initiate paternity proceedings, etc. - is up to him.
