    Divorce After Spouse's Affair
    I am about to file for divorce from my wife who had an affair. The one question I have is our cars. Her name is on my car and vice versa. The cars are not paid off and the insurance is under as a married couple. My concerns our my name still on her car. My car I am about to refinance by myself to get her off of it. What legal matter can I take if any to remove my self from her car? She is still seeing the other guy and I cant trust him driving the car. I dont want anything coming back to me if a car accident should happen by him or her. I only say this due to the fact the car insurance doesnt cover other drivers of the vehicle.

    You are taking the necessary step with your own car - refinancing it. If your wife cooperates, you can arrange for the refinancing of her car as well to remove your name from the loan and title. You can check with the lender to see if, under the circumstances, they will agree to allow you to remove your name from the title even if your name is not removed from the loan, but absent their permission it is unlikely that you would be able to retitle the car without refinancing.

    When you file for divorce, you can speak with your lawyer about the possibility of obtaining a court order compelling her to refinance the car, or at least compelling her to provide insurance which covers all people she permits to use the car, with some form of indemnification clause if she doesn't abide by the terms of the order and as a result you suffer an economic loss.
