Credit Card Payments Until Chapter 7 Discharge
My question involves bankruptcy in the state of: Maryland
I have just paid my attorney his $250 retainer. I still owe him $1469 (this price includes his fees and all the court fees, credit reports, etc). I asked how I could pay him and he said he need the $1469 before he starts the process. I told him
I could have him the money in about two months, he said this is fine.
Then I asked if i should continue to pay my credit cards. And he said 'No' you should not.
Now I have to go two months without paying my credit cards.
So the question is...are the credit cards companies going to start to hound me for money after two months of non payment?
Thanks-Peter
Re: Credit Card Payments Until Chapter 7 Discharge
Yes, its likely that they will hound you. Once your attorney is paid and they call, you will direct their calls to them. You should not make a payment to any cc companies, this could hinder your ability to file.
Re: Credit Card Payments Until Chapter 7 Discharge
You don't want to pay on any credit cards/pay any unsecured creditors in those two months prior to filing for bankruptcy. If you do, they could be considered "preferential "transfers" - paying certain creditors instead of the money being distributed among all your creditors. This could affect your bankruptcy.
Re: Credit Card Payments Until Chapter 7 Discharge
Making any payments to credit card or using a credit card within (90 days) of filing for bankruptcy may result in the credit card company calling your bankruptcy claim as fraud.

Does this mean using your credit cards 90 days prior to filing bankruptcy or just after you file? Is it better to stop paying your credit cards before filing o wait until your lawyer says to stop paying?
Re: Credit Card Payments Until Chapter 7 Discharge
Don't make any more payments on your credit cards prior to filing as your lawyer per your first post also told you not to. Also, don't use the cards any more prior to filing.
