    My question involves a background check in the State of: NEW YORK

    Hello, how are you? I have a fellony on my record (2nd degree burglary) which was dropped to a misdemenor of tresspassing, I received probation and my youthful offender status. I work in health care and I am going to college to become a registered nurse. It was made clear to me that on my job applicatons, I could mark "no" for ever being convicted for a fellony or misdemenor because of my youthful offender status and now, after being hired, the results of my backround check came up and everything was shown and in parethesis was youthful offender status as so, Burglary 2nd... (Youthful Offender Status). I showed the paper to my probations officer and she did not know why this had happened to me. I ended up getting it cleared with my place of employment with the NYS Dept. of Health. I guess there is a law that while working in health care, everything on your record can be shown even though i received youthful offender status. So I am just wondering if there is a way I can get this charge off of my record so I will not have anymore problems with employment in the future when I have my nursing degree.

    I don't know of any way to seal a New York record, beyond the seal you receive upon youthful offender adjudication, save where the disposition was entirely favorable to the defendant (e.g., if you were acquitted or received an outright dismissal or, with limitations, an ACD). I won't rule out the possibility that there is a way, but at this point have to suggest consulting a New York criminal defense lawyer as it isn't obvious from the case law or statutes.
