Sponsoring My Sister to Become a US Citizen
Hi,
I am a US citizen and would like to sponsor my sister to become a US Citizen. She is currently legally in the US on a visitor's visa.
My questions are;
1. If I filed for a pettion today how long on average will it take before we hear anything from Immigration? Few weeks, months, years?
2. How long would it take on average for her before she can start working (does she need to wait for green card approval or is she allowed to work while her case is pending)?
3. Does she need to leave the country (while her case is pending) before her visitor visa expires?
4. If she leaves the country will she be able to come back on a visitor visa while her case is pending?
Thank you for your time and hopefully your response
I am from Portland, OR
Re: Sponsoring My Sister to Become a US Citizen
Start here.
Since she's already legally here, she may be able to file an I-485 to allow her to adjust her status to Legal Permanent Resident. She MAY NOT work until she has a Green Card and work authorization. If her I-485 is approved, she must stay put - she cannot leave the country without advance permission.
Depending on where your sister is from, obtaining a visa to immigrate could take years.
You'd do well to consult with an immigration attorney.
