Modification of Child Support Loan
My question involves child support in the State of: california (bute county)
Guys does anyone know how to modify child support?
my bf owes 50k his son is now 18. and i know we are stucked with that debts, is there any way we can lower that loan without hiring anyone?
we really want it to be lower than that.. hes only a part time worker, and doesnt earn enough, what are the procedures? thanks a bunch!
Re: Modification of Child Support Loan
If he's only a part time worker, he needs to become a full time worker. "We" are not stuck with the debt, he's just your boyfriend. He is stuck with it, not you. He owes the person who raised his child (with either no or minimal help from him). That person probably didn't get a discount on raising the child, neither should he.
Modifications of support modify the support order, they do nothing to wipe away the arrears (the money already owed). The only person that can do that is the person to whom the money is owed.

The first thing your BF needs to do is to get a full time job. Once he does that, and still has problems making the full payments, he can try to file for a modification of the payments. (He will still have to pay the full arrears, federal law prohibits retroactive modifcations of arrearage amounts).
He should NOT try to file while he is only working part time, he must be able to prove to the court that he is fully employed and earning at his max potential.
You used the word "loan", CS arrears are not a loan, they are court ordered CS that was not paid when it should have been, that is very different from a loan.
