Quit Claim Deed for the Marital Home
My question involves divorce in the State of: North Carolina
My husband left 1 month ago after 15 years of marriage, he has agreed to give me quit claim deed on marital residence if i give him power of attorney for his vehicle. If i do this now will the house truly be mine or will just my name be on it and he still has rights to it?

A quitclaim will not necessarily prevent him from making a claim against the marital home in the divorce, nor will it remove any mortgages, liens, or other encumbrances that are in his name. But, if properly done, it will remove him from the title.

What if it is a part of a seperation agreement? and in the agreement it states that this is in lieu of equitable distribution? Then will it definitely be mine with no claims from him? I dont want to sign it if i dont get the house and he is getting pretty much everything else and by far he is getting the better money deal. I just want the house because the kids feel like it is there home, and they dont want to move.

I can't comment on a separation agreement I haven't read, let alone tell you if a court will enforce it.

Agreed, you need an attorney and you also need to file for child support. This will be forever so you need your own advice from a local attorney.
