I Want to Have Sole Custody of My Child
My question involves a child custody case from the State of: Florida
I have a 7yr old and Im looking to gain full custody of my her, Now I havent been with my daughters father since she was 1yr old (I had to get out of that relationship because he verbally and physically abusive, we only lived together for 4 months). When I left he threaten to kill the three of us since we couldnt be together so I got a restraining order which was ordered to be indefinite in 2003, in that same court order he was ordered to pay child support (which he does not) and had a very strict visitation order in which he would comply on and off, he would go months w/o seeing her until the person whom had to supervise the visitation would show up out of the blue to pick her up and she would be so happy because she had this big attachment with her father, she always looked forward for the next time. Then one day that all changed,she came home one day in 2005 early from her visitation,crying saying that her dad had touched her really hard on her pee-pee(my daughter was 4 at the time), I then took action(I COULD NOT DOUBT HER THE WORD OF MY FOUR YEAR OLD WHOM COULDNT OF MADE THIS UP) and filed a report and tryed to prevent him from getting near her but because they said there was no physical evidence then they denied the case (basically there has to be some sort of penetration in order for them to take it seriously which left me with little faith in the justice dept) my daughter has not had any contact with him since, she is terrified of him and at some point had to see therapist(whom also stated that something happen, the problem is that she is not ready to cope with it so would not talk in detail about it) she stop going because it got to a point where they would ask her questions about him and after that she didnt want to go (she closed herself out). She has not seen him in 3yrs and now that she is 7 the only way she sleeps in her room is if the shudders are closed and locked because she says that he could get a ladder and climb our two story house and get in her room and take her. Theres alot to my case and that is why I have to explain so much, I was looking to go on a family trip with my family and needed to get her passport when he was asked to sign he stated he would if i let him claim her on his taxes (this is a person whom has not done a thing for his daughter I have been the sole provider at all times even when he was orderd to pay her insurance he didnt and I had to get it and pay it for it myself). Now i have a fiancee whom is in the army and when he gets back from Iraq we are to wed and he has three tours left to do....I want to be able to travel with her and have full custody of my daughter w/o having to worry....What are the chances? How do I go by doing this?

If you want sole custody of your daughter, petition the courts to modify your custody agreement. I suggest getting an attorney to help you with this.

Unfortunately, you will definately need to hire an attorney. Make a list of all of the issues and all of the evidence, and witnesses that you have. Then take them to an attorney who will be able to give you an idea of how much of a chance you have of prevailing in court.
Another thing you should do right away will be to file a motion for contempt for the non payment of the CS. You do not need an attorney, you can find the forms at www.flcourts.org. Or, if the DOR CSE is enforcing your case, talk to your caseworker about a contempt motion.
