Garnishment on Checking Account
My question involves judgment recovery in the State of:Virginia
In 2003 I became disable and had a loan with Washington Mutual I had disability Insurance on it then they redid the loan and did not put the insurance on it and they already new I was disable and wanted to file claim we argue over this and i fell behind even more needless to say they went and got a judgement against me and I wasn't able to go because of surgery and was told I didn't have to go.
Now Mann Bracken got a garnishment on my joint checking account which both of us have direct deposit of Social Security Checks the only money that goes in there.The bank is honoring the judgement I have a court date Nov 19 2008 to answer to this.Already I fax papers to the court proving this my attorney called the bank,Mann Bracken and got no where.
Mann Braken knew I was on SS back in 2005 when they tried to get a double judgement on me for this same loan my attorney help me on this I have no other means of money and my bills I paid have been return banl charging overdraft fees and 100.00 charge for this garnishment.What more can I do?
His my home in jeporady its joint ownership also the loan amount is 2,286.00.
My husband just got out of ICU and we really need our money what more can I do? Help Help

Who was the judgement against ...just you? or both you and your husband?

i highly doubt that Mann Braken remembers you to make this as personal as it seems. They just want their money. Where was your attorney during this matter? Did you go to court or ignore the papers?

hire a lawyer to help you. Borrow from relatives. Call the bill collectors and let them know that your having problems right now and you'll be late. They may be willing to take partial payment.

Have you checked to see if you qualify for legal aid?
