    My question involves criminal law for the state of: New York

    I was in court on Tuesday, I took out a family offence against my ex wife, the judge ordered a 1034 investigation, the DSS worker stated in court she investigated and she found no abuse, I asked if they talked to the kids they stated they had

    Now I talked to my kids that night the said no one ever talked to them about it, I called DSS the next morning and they hung up on me when I asked when they talked to the kids.

    So I called the Albany Office that controls the Montgomery County DSS after a few calls and explaining what was said, they told me that they should not have lied, and that they had a meeting with the Law Guardian that day or the next to meet with the kids so I called the law guardian and he said no, no one made an appointment so I called Albany and let them know they lied again.

    What can I do about this?

    What do you mean when you say that you "took out a family offense against your wife"? Are you meaning to say that you reported an allegation of abuse against your ex-wife? Was the matter then heard in an administrative setting before an administrative law judge or was this heard in trial court?

    Did you receive a written report of the agency's findings as to the allegation?

    Were you represented, or did you proceed on your own?

    Was there an actual contested hearing where the social worker's testimony was taken under oath wherein she was subjected to direct and cross examination?

    Was DSS represented by a state attorney at this proceeding?
