Suspended License, Never Had One
My question involves a driver's license issued by the State of: Utah
So in Utah my license was suspended aside from the fact that I didn't have a license and as far as I know it wasn't a moving violation, not the point though. I'm in the process of getting everything worked out in the state, however it is difficult as I don't live there anymore. My question's are; am I going to have to pay in Utah DMV to get the license reinstated even though I never had the license? And, will this hold that they have on it get taken care of if I pay the monies I owe the court without me having to appear in Utah?

Yes. One presumes you were charged with driving without a license?

You'll need to check with the Utah DMV.

No, I wasn't driving. It was a possession of paraphernalia misdemeanor, apparently Utah state laws dictate that you get your license suspended for that. My question was if I would have to pay the reinstatement fee even though I didn't have a license at the time and the charge had nothing to do with driving.

It is not your license that is suspended or revoked; it is your RIGHT TO OPERATE. Plenty of people who have never had a "License" have a driving record. It is not so much the piece of plastic in your pocket as it is the "right for you to operate a motor vehicle in their State" that you have to reinstate.

So would that be paying the DMV or paying both the DMV and the court? I'm already going to paying the court for my fines, but I'm wondering if I can pay the DMV a reinstatement fee before my court fines are paid.

Both. The DMV normally represents the State. The State has certain requirements you need to fulfill as does the court (normally representing the county). You pay court fines to the court and reinstatement fees to the DMV. And, yes, you wil more than likely pay both State's DMV reinstatement fees (the State where the incident occured as well as your State of licensure should they suspend your right to operate because of the out of State suspension)

You can only pay the DMV reinstatement fee if you suspension period has run out.

It is over, I just wasn't sure if I could just pay the reinstatement fee and go on with my license. So let me get this straight as I'm a bit confused here, so with my suspension being up I can pay the reinstatement and get my license?

In which State? The offense happens in State "A". If the offense carries a suspension for simply not paying the ticket and you are just suspended pending payment of that ticket then you pay the ticket then the reinstatement fee. Then, there is the State where you are licensed. They may have suspnded you due to a suspension in another State (keep in mind that they don't know what it was for). So you contact the DMV in your State and, if you are suspended, you need to show them either with a letter of clearance from State "A" that you cleared up the issue, or they can normally run you through NDR (National Driver Registry) to see that you did, in fact clear it up. Once they have that proof of reinstatement in the other state, /.....................then you can pay them their reinstatement fee. Whew.....and to think I do this stuff all day long every day.....sounds exhausting doesn't it?

State "A" gave me a suspension for the charge, as far as I know I wasn't suspended for not paying the ticket. State "B" told my license is on hold in state "A", which is where I presume I have to reinstate my license? And yes, it does sound exhausting...and I'm sorry to keep troubling you but I need to get my license.
