Charged With Throwing Something Into Neighbor's Yard
My question involves court procedures for the state of: Pa
My husband had a hearing yesterday, charged with throwing something in a neighbors yard. Anyway the cop that filed the fine, He lives in our neighborhood, and is good friends with the person accussing my husband throwing this item, ( This person does not like us)
We went to the magistrate to fight this charge, ( It was a large fine),The magistrate and the cop were talking about this in the back room before the hearing, ( The magistate also is from the same township, but not my neighbor)
Well the cop started, called his withness he said yeah I saw mr. --- throw something out the window, ( by the way, this person was block away, from the yard of where he "saw" my husband throw this item) so he said when he got down to the yard, he saw this item. And then called the cops
Well the cop never produced the item thrown, The magistrate didn't want to hear anything, When it was my husbands turn to speak my husband said he had proof from our bank that he was not in that area anywhere near the time. He asked the judge if he wanted to see it, and he rolled his eyes and said no, let the cop see it, The cop said this is not proof, you need a video tape. I said what? but the guy who accused my husband did not need any proof, just his word. The judge didn't even let my husband finish. He said your guilty, that it.
When the cop came to our home, to let my husband know of these charges, prior to the hearing, I said this is the 3rd false accusation made agaist us in 8 days, he said oh stop noone is bothering you. And the cop knows that the 2 neighbors don't like us and wants us to move, and he allows this, my husband asked him to take finger prints from the item, he said it was laying outside all night there is no prints, my husband said what about DNA, the cop said are you going to pay for it, It's millions and millions of dollars, My husband said I'm trying to prove it wasn't me. So how can the judge find my husband guity with no evidence presented from the cop, and my husband had evidence. What can be done? The cop and magistrate are friends and corrupt.
