    Contested Minor Name Change in New York
    My question involves name change laws in the State of: New York
    My daugter is 12 and has used my maiden name since she's been able to write because she has not been raised with her father around. He is supposed to but does not pay child support and has not seen her in a few years, he will say it's due to me but it was his choice to miss his mandated supervised visits with her! I would like to legally change her last name but he will not approve it because he knows it bothers me having his last name still involved, he could care less that it bothers her. How can I help her change her name to the one she uses

    File a petition with the court. You'll need to prove that the change will be in your daughter's best interests.

    have you filed to enforce the CS order? If you haven't, you should do so, not only will you be doing something to enforce the order, it might cause ex to rethink allowing a name change.

    I was filing to enforce the order every 6mos but when he did finally show up,after always skipping the 1st apppearence, he would give the courts $200 to pacify them and say that was all he could afford due to not working and they would always allow it, so that didnt scare him at all. I'm afraid to spend all of the money to try and do this just to let her down again.
