    Sending a Naked Picture to a Minor
    My question involves criminal law for the state of: Connecticut

    I'm worried about my nephew, who sometimes, can have lapses in judgement. He is 19 years old. He met a girl in some online chat room, who is 17 and they exchanged regular pictures and what not. Then they got to talking, and he decided to send a picture of his genitles to her, in exchange for a picture of her breasts. He sent the picture, of only his genitles, not including his face, or the rest of his body, via cell phone, thus making it easy to track him. He got no response, and called me freaking out, thinking it was a cop that set him up. 12 Minutes later, he received a topless picture of her, without her face as well. This calmed him down a lot, thinking maybe if it were a cop, they wouldn't have sent a picture back. He also felt the picture looked like it could match up with the females clothed picture. While he was calm for the night, he called me again this morning, still scared. Here is my question:

    -What are the chances this is a cop? Would a cop reply with a message like that?
    -Is this a crime? If so, what are the remedies.
    -Should he be worried, or can I tell him to relax?

    Please respond ASAP, as I'd like to get this straightened out for him ASAP. Hopefully now he can stop being so stupid, and learn his lesson from a close call.

    Let's see...

    Let's start with the, at least, 3 federal class 3 felonies that he broke by sending a picture of his boys.

    Then, let's add the, at least, 3 federal class 3 felonies that he broke by asking a minor child to produce child pornography for his use.

    Then, let's go ahead and add the NUMEROUS felonies he has committed by the willful demand, creation, receipt and possession of child pornography... because unless she is actually 18... child pornography is exactly what it is.

    without even trying hard, I can see your nephew going to jail for decades.

    Chances are good. Stings are common. Yes, a cop would respond in kind. That's how they catch people.

    Yes it is. He could be tossed in the klink AND have to register as a sex offender. Yes, for cell phone pictures. Last week, a teenager here in Ohio was charged with creation and possession of child pornography for using her cell phone to send naked pictures of herself to some classmates.

    Teenagers, even older teenagers, are morons. It's their birthright to be morons, to be sure, but they're still morons. Thankfully, your nephew has you to bap him across the back of the head and tell him to stop being a moron. That's a good thing.

    Don't tell him to relax. If the cops haven't shown up at his door by now, it was probably not a sting.

    Even so, you want this kid to have FEAR in his heart so he doesn't do this again and end up messaging a cop for real.

    Jeff, if you could site these sections in the US Code, as I am curious to see if they have a federal element to them.

    The sections I looked up require a federal element, meaning in interstate or foreign commerce, and do not define "child pornography" as a topless picture of a minor.

    Tell your Nephew to knock it off and find kids his own age to hang out with.

    I don't want to answer another thread by you with the following title.

    Nephew going to prison, any info on prison life.

    Bottom line is this, chatting with people online in chat rooms about general stuff is fine. But if you start chatting about other things it is time to get off the net.

    Your nephew is much better off finding someone of his age. Which I mean 18+ years of age.

    First I'd like to thank everyone for there feedback so far. Second, I'd like to tsay to the post above me, I never posted anything in any other topic. I apologize if you got confused with someone else and there uncle, but I just joined yesterday, and posted that. Let me update everyone on the situation:

    We have heard nothing from law enforcement. To say the least he is shitting himself. It's been 2 full days. For my sake, can anyone tell me if this is a good sign or a nonfactor. I am punishing him beyond beleif, but I dont even know if thats necessary. He has punished himself enough. He has not been able to eat, sleep, or drink, which in this case, I think is a good little shake up. He needs to learn what he did is BEYOND wrong, and BEYOND offensive. It not only could, but will ruin his whole life. Hopefully this experiance wasn't over the line to get him in trouble, but close enough where he will be taught a lesson very dear to everyones heart. Does anyone agree or disgaree with me?


    Also, I read this after doing research from one of the previous replies. Which part of this if any applies to him?

    Facts: He is 19, she claimed to be 17. They exchanged a picture of male genitles, and female breasts, no faces or other body parts included. (Through Cell Phone Text Messaging) No sexual acts were described, referenced, or asked about, and no talk of meeting took place whatsoever.
