H1 Transfer Back to Previous Employer

Hi All,

I am in trouble so need some immediate guidance. I just joined a new compnay 4months back after transfering my H1. The new company(E) has received a RFE and the transfer is not yet complete. Now, at this point because of economic slowdown they are laying me off. If I want to go back to my previous employer what should I do? This 17th is the query date USCIS asked for. If the new company is not proceeding with the H1 transfer what will be my status, please suggest. Anyone has any interim solution please let me know.

As long as your first employer did not revoke your authorization, and that would be unusual, you go back to work for your former employer. The "transfer" of itself does not affect your authorization to work for any approved employer.
