    Removing a Name from Child's Birth Certificate
    My question involves name change laws in the State of: North Carolina

    When my daughter was born in 2004 the vital records staff at the hospital told me that since i was still legally married to my ex husband that the state of North Carolina did not allow me to put the name of my daughter's father on her birth cerificate. I informed the staff that my ex husband and i was no longer together and that he was not her father, they told me that if i did not want his name on her birth certificate that i could refuse to have his name on there so i did just that not knowing that in place of a father's name on the birth certificate that it would indeed state REFUSED. Now that i am divorced and my daughter's father and I are married how do i go about having that refused removed from her birth certificate and having her father my husband name respectfully taking his title as her father. Please help this is his only child and it will make him more than proud to have his name on his daughter's birth certificate.

    Did you disestablish paternity as part of your divorce proceeding?

    When i asked my question to vital records they told me that i needed to see a lawyer to find out how to remove refused from the birth certificate. But when i contact lawyers over the telephone all they tell me is that i need to come in for a confrontation and they starting rate is $75.00 or more an hour which i feel is to much when it may be something i can do that is more simple to have the refused removed. As far as my husband adding his name vital records said that he can just come in and sign if the refused statement was not on there and it was just left blank.

    Aaron : As for paternity in my divorce it was no doubt in mind as far as my daughter not being my ex husband child my ex husband and i had been seperated for over a year before my daughter was born but just because my divorce was not final as to date of her birthday her father name could not go on the birth certificate. Our divorce was a very simple divorce.

    Paternity was established when your husband's name was added to the birth certificate. Did you disestablish paternity as part of your divorce proceeding?

    His name is not on the birth certificate there is no name in the spot where a father name is to be listed instead the register put refused that is why i am trying to have refused removed so her father can just go down to vital records and sign his name but it is more difficult then is sounds. So im asking how do i go about having refused removed from the birth certificate. My ex husband name is not listed any where on her birth certificate.
