    Getting Emancipated or Changed Guardianship
    My question involves emancipation laws for the State of: Mississippi I am sixteen and i can't live with my parents anymore. They are mean and hurtful and abusive in the emotional and sometimes physical sence..I can't be here any more.. I'm not just some brat who doesn't want to live with mommy and daddy any more i just need out of this house. I wat to get emancipated or have my guardianship changed to someone who cares for me. I am graduating highschool this year if that helps. Just please tell me what i need to do to make one of those things happen- either emancipation or changing guardianship-!!

    First, you tell us your plan for independent living. How much money do you earn? Where are you going to live? How much money do you have in savings?

    Who has stepped up to the plate and offered to be your guardian?

    Emancipation is appropriate for minor who are already supporting themselves financially, emotionally, scholastically and so on. It's for kids who because of odd circumstances are forced to be more mature than other kids their age.

    Generally kids who still refer to their parents as mommy and daddy aren't mature enough for it.

    To get emancipated, you'll require a job which allows you to pay for: your healthcare, transportation, rent, phone, food, school supplies, fees and dues, clothing, electricity and so on.

    If your parents are abusive physically, then next time one smacks you, call the police and have them arrested for assault (domestic violence). This history of abusive can greatly improve your chances of becoming a ward of the state.

    Just because you're a minor and under the control of your parents doesn't give to them the right to assault you.

    This is the best I could find which describes emancipation in Mississippi.

    It provides in part that:

    (ii) Voluntarily moves from the home of the custodial parent or guardian, establishes independent living arrangements, obtains full-time employment and discontinues educational endeavors prior to attaining the age of twenty-one (21) years, or

    So, apparently you have to stop being educated to be mature enough to pay your own bills and live on your own in Ole Miss.

    my parents want let me get a job i have somewhere else to live so just tell me what i need to do to get away from them..please.. i will work and i will get my G.E.D no problem as soon as i can get emancipated i just need to know what to do. And Would it help if i had people over 18 or 21 to sign a petition for the judge saying they agree i should be emancipated?

    You have to present to a judge, not just "I'm gonna get a job" but "I have a job. I pay x amount in rent, x amount in utilities, x amount for food, x amount for school, x amount in savings" ect.

    You have to have a better reason than, "My parents are mean to me".

    You have to be able to show the judge that you are ALREADY capable of caring for yourself, not that you will be able to do it as soon as he lets you get away from mean old mommy and mean old daddy who don't let you do what you want.

    And that place you have to live? You have to be able to show that judge that you will be able to continue to support yourself if the people who are letting you live with them change their minds and kick you out, or if they get run over by a bus, or get transferred to Oregon and don't want to take you with them.

    thank you very much for all your time and answers i will do whatever i have to to get emancipated.. i'm just kinda burning my wheels here bc i don't want to try and fail and then only make matters worse!! so basically if i have a way of supporting myself completely i can emancipate.. What if i am still in school?? would i necessarily HAVE to b out of school or could i get m G.E.D after i got emancipated would a judge go for that??THANKS

    thank you very much for all your time and answers you guys are the only people that i can ask and youve been a big help. I'm just kinda spinnin my wheels here bc i don't want to try and fail and make matters worse.. so basically all i have to do to emancipate is have a way of supporting myself comepletely? what if i am still in high school can i get my G.E.D as soon as i get emancipated?? my parents want let me get it right now so would a judge let me get it after i got emancipated??

    oh and by the way the school i go to uses homeschooling material so i have all the books i need to graduate except a few score keys i could buy so would that help my situation any?

    A Judge most likely will rather you stay in school. Supporting yourself 100% is just one of the requirements. You need to have a valid reason why this would be in the best of your interest.
