    My question involves a speeding ticket from the State of WA. This happened @ SR 509 n/b.

    I have got ticket for 60 in a 40 mph zone for $195 by a Port of Seattle Police officer.

    I filed for discovery, and have recieved the officer's affidavit of Speed (RADAR) filed by the officer within the same day and the ticket submitted within 5 days.
    He said to have used Decataur Genesis VP. He said he was stationery mode on N/B SR 509 at Cloverdale st. (he didnot write S. Cloverdale st.).
    He saw my vehicle pulling away from him rapidly North on SR 509 at M.p 30 block. (doesnt mention inside, outside, middle , or only.......none of the choices are selected)

    he says that the digital readout was 60 mph, and I was passing slower traffic at the time of the violation.


    the mile post 30 is between the sign reading "reduced speed limit ahead 40 mph" and speed limit sign "40 mph"
    Officer when clocking me is in the 60 mph zone, saying he clocked me going north on SR 509, and it curves around the mp 30 going to the 1st ave bridge, where the speed drops to 40 from 60 mph.


    People familiar with this route, please give some advise, as of how to defend this.

    To add,

    I did see some Port of Seattle cars giving out tickets on both n/b and s/b SR 509.

    Date of citiation 8-30-8-08

    Court date: 10-27-08

    Although it has happened on more than one occasion, the odds are low that one of our ticket gurus is going to be familiar with this particular stretch of road.

    Okay. I mean to create the situation.
    Anywyas, I went to the court to see the calibration records for the radar, and the court clerk said that she doesnt have any record of that particular instrument # being calibrated.

    Is that sufficent to get the case dismissed ? and if under what law?

    Also, is it legal for an officer to give a tacket when he radars a vehicle, and he himself is in the 60 mile zone and writes up a ticket when the vehicle is on a curve to the right entering a reducing speed zone from 60 to 40 and then enters a 40 mile zone after 1/4 of a mile?

    Please advise, thanks.

    As far as the filing of the radar certificate, IRLJ 6.6 (d) is the rule you're looking for.

    As far as your other points, all you can do is take pictures of the area and hope the court believes you.

    Also could you also help me (or anyone) as of how should I proceed.

    Choice #1: The officer clocked me in a zone which is actually a 60 mph zone while he himself is in the same zone. He clocked me in a reduced speed entry zone and writes me up for 60 in a 40 mph zone

    Choice #2: That there were no records present for the calibration of the device in the court.

    Any other choice, if someone can suggest.
