Naturalized Citizen Sponsoring Husband
I am a naturalized US Citizen, and I've married a foreigner in Jan 08, and shortly after that submitted the required paperwork for a green card application.
The problem is, I 've filed for divorce a month after I've been granted a citizenship. INS sent a request for evidence, asking for the initial application for divorce. I live in a state, with a one year separation requirement. On my divorce documents, i have stated that i have been separated for a year. On the interview ( for my husband’s green card ) , I said that I was separated later (when i filed for divorce).
I know, I have made a mistake...i should have waited for the one year separation period to go by....
If they go by the divorce documents, it looks like i have not been eligible to file for naturalization.
Which case is worse?- not complying with the one year separation, or not being eligible for a naturalization
What should i expect to happen?
thank you all for your feedback!
Re: Naturalized Citizen Sponsoring Husband
Your timeline doesn't make sense. This January, 2008 marriage was a remarriage following your divorce?
The rest of your comments suggest that the USCIS is investigating you for having procured naturalization by concealment of a material fact or by willful misrepresentation. If that's the case, you need to get help from an immigration lawyer.
