    Six Years of Stay in Country Will Be Up - What to Do?
    We arrived in the USA on nov. 2002 on an L1..
    Changed to H1 in 2004.
    Left country and reentered for family emergency [Jan-feb 2005], on above H1.
    Changed employer in 2007.
    H1 renewed till 2010 from new employer.
    GC is being processed by new employer, and we are waiting on I-141.
    Tried expedited processing, which got rejected. [based on lawyer's suggestion]

    Question: Can we stay till 2010 and travel out of US in case of any emergency.
    Some people said that 2008-2006=6 years, and anytime after nov. 2008, is an overstay.. Is it true?

    I need help on what we should do legally? I'm not okay with taking chances, overstaying, gambling etc. as our career is the basis of GC processing..

    Would appreciate any help on this. Thank you in advance.

    You mentioned that you have an attorney.

    Have you asked him about this?

    If your H1 is valid until 2010, you ought not have any difficulties, but don't even consider traveling until you've discussed this with your attorney.
