    My question involves emancipation laws for the State of: California

    I am a junior in highschool and I have just turned 16. I understand the law is not really on my side at my age, but I really need the emancipation.

    My parents are not physically abusive, however they have hit me before because we are an asian family so asian parents do that so I do not consider it abuse but I do not know if the law considers it as abuse. And they treat me like a prisoner.

    Anyways, My dad and I used to be really close. All of a sudden a week ago he changed and is now on my mom's side.

    About a week ago, I was sick for 8 days. Fever, throwing up, and headaches every day. My mom would not let me stay home but I stayed home anyways. When me and my dad were still cool, I told him that I'm sick and mom won't let me stay home but I really feel like crap so I'm staying home anyways. He agreed and let me. After my week of absence, my asst principal called my mom, telling her about my week of absence, asking where i was. She acted as if she knew nothing, pretended that I never told her I was sick. All those absences turned into truants. I have saturday schools until the end of this year and possibly continung onto next year. I have homecoming, winter formal, sadies and this years prom taken away. I can go to prom next year though, but Im not concerned about the dances. My parents act like I never even told them I was sick and is punishing me for all those truancies. They will not let me go out. I have been going to my friend's house for almost a week now because I have to copy notes that I missed during that week. That is the only place I can go out. I have a boyfriend who is 18 years old. He is leaving for the navy in 3 days. He was about to delay his shipment until I was alright, but his recruiter said now or never so I told him just to go. I might get kicked out, so he left me his bank account, and he gets paid for boot camp and A school. He is going to transfer his paycheck which is about $600 a month to me incase I need money to support myself if my parents kicked me out. He will come back in 5 months and when he does, I plan to move out with him because he is going to get a place of his own when he comes back. When I go to my friend's house to copy the notes, he goes there as well so I can spend time with him until the day he leaves. Even if I'm at my friends house copying notes, they drive past it to see what I'm doing so we moved into my friends room so they couldn't spy on me. They used my cellphone bill to see whove I've been calling. Then, they called every single number on there! I have no privacy whatsoever, they follow and watch me everywhere. I got my phone taken away a few days ago but I stole the SIM card and put it in one of my old phones. I do not want to waste my time at school like saturday school for something that was not my fault. Is it my fault that i was that sick for a week? It isn't! What Im going through right now is absolutely ridiculous and I need to get this emancipation passed for me. I do not know how to start though. And at 16, I don't think I can work without a work permit with the approval of my asst principal but he wouldn't give it to me since he knows what is going on with me so he would never approve it. I need help! All the people responding about this subject has just copy & pasted the laws of amancipation for minors but I just need someone who mabe has gone through the emancipation and tell me in plain english. I've already read all the laws of emancipation over the internet, I need help as to how to get started on it and see if they would allow me to be emancipated and be independent on my own. I already take care of myself now, the only problem is the work thing, but my boyfriend is sending me the money every month for 5 months and will be working when he comes back, is that enough?

    Nothing you have posted is going to convince a judge that you will be harmed if not allowed to emancipate. Nor can you be emancipated if you need help from someone else to support yourself.

    In plain English.

    No judge in any jurisdiction is going to emancipate an unemployed teen with a truancy problem to live with a boyfriend.

    Never going to happen.

    As to the rest...Let's see....

    You mom told you to go to school. You refused. That would be the definition of truancy.

    You are diagnosing yourself... unless you have a medical degree tucked up in there, you don't have the authority.

    Then, to prove you can't be trusted, the one place your parents allowed you to go you use to "see" your boyfriend.

    Never going to happen.
