Debtor's Credit Report Shows Two Bankruptcies
My question involves bankruptcy in the state of: California
In reading the 'comprehensive report' the debtor's records show:
Chapter 7 Bankruptcy: date filed - 4/16/2004, disposition date - 7/26/04, Disposition: Discharged
Chapter 13 Bankruptcy: date filed - 08/08/1991, disposition date - 1/15/92, Disposition: Dismissed
In plain English - does this mean he was not allowed the BK in 92 - but was granted BK under chapter 7 in 2004?
Is it true that he can not file again under chapter 7 until 2011?
Is he allowed to file sooner than that under chapter 13?

You would have to ask him why the bankruptcy was dismissed in 1992. It may have been a voluntary dismissal. The debtor would normally be ineligible to file for Chapter 7 bankruptcy for eight years; but he can file for Chapter 13, as no waiting period applies.
