    Emergency Custody in Kentucky
    :wallbang:My question involves a child custody case from the State of: KY, OH, TN

    My son was taken from his mother by the state of ky. that happened in June. He was then placed with her step mom who was accused of abusing him in july. He was taken into foster care until the court decided what to do with him last week. The judge gave him to his moms mother in ohio because my home study wasnt completed yet and their wasnt proof of paternity.
    In court the judge told my sons custodian " lisa" that she was not allowed to leave him alone with either of her two kids because they are drug users. she has been doing that everyday. yesterday I had the cops do a wellness check on my son and they told me that he was alone with lisa's son and that her son said that it was ok for him to babysit. the cops took report of this like they always do. I notified the cabinet ( cps in kentucky) and of course they did nothing but call lisa and yell at her. She was in direct violation of a court order.
    Do I have grounds to file for emerency custody since she is not only in direct violation but has no childcare and is leaving my son to be watched by a drug addict?

    Has paternity been legally established yet? Is your home study done?

    You can't file until you've legally established paternity. If you have, hire an attorney and go fight for your son.
