Possession in Michigan

My question involves criminal law for the state of: Michigan

ok here is the case one day me and my buddy and my gf were driving about when my friend ask i want to smoke, so i said yes and we made our way to the (what we thought was a secret smoking spot)church we smoke at. we already had less of a dime on us mostly enough for two bowls. as we finished the first bowl my friend lights up a 2nd thats when 4 cop cars come and box us in. they took me out of the car first and asked me what we were doing, hoping my friend had hid his stash i said just smoking cigerettes (which i had in my hand at the time) well they didnt search me but they did search the jeep and my gf and my friend in which they found papers in his jeep and the little amount of weed on him. so the cop comes back to me and says were u smoking so i told him yes we were i figured why lie now, than the cop asks me who's weed it is i told him i did not know all i know is we smoked it, than the cop says my friend is trying to pin the pot on me, now i know my friend better than that so i told him i doubt thats true but what ever i sware it isnt mine, so eventully they tell me my friend claimed the weed. which i knew he would because he wouldnt let some one fall for something he deserved. they then start drilling me on if my friend was growing or selling, i told them the truth that he was not, so they take me and my gf home in a cop car and they let my friend drive his jeep home, they didn't give us a ticket or anything. later on i find out that the cops told my friend that i was pinning the weed on him which i was not, they also accused my gf of owning the weed (who is Straight Edge wants nothing to do with it she has never smoked it before and had i not been there she would have left)

well anyways to cut the story down i got a court paper today telling me im being charged with CS POSS MJ now is this possesion of Marjuanna? if so how can they do that if my friend took the claim and they didnt even search me? will my gf most likely get charged? this doesn't seem to make sense can they charge me for being high 3 months after it happen? or can they get me for possesion because it was in my system?

Excuse me? you are very rude. i just asked a few question's to know what im in for if i deserve the punisment then i do, how dare you attack me, you dont even know me. i have smoked maybe a few times i am not a "pot head" like you would label me, i have a life i am a happy person back off my case lady.

also since they did not search me they have no proof i was in possesion of it, also had they searched they would have found nothing because i never buy it nor keep it, also they did not drug test me they have no proof it was in my system. so maybe you should read the whole post before you fly off the wall about what kind of person i am mam

I "dare" say that pot smokers stink because THEY DO. Just like tobacco smokers stink. When the chemicals enter into your bloodstream, your skin emits a distinct odor.

You wanted to know how the cop could charge you with possession. That's how. He could smell you. It's simple science. Learn you some.

I wasnt looking for sympathy i was looking for just that, Facts.

I didn't know that a smell could be associated with possession. If I'm not mistaken there are incense that produce a marijuana like smell that are completely legal to have. Does that mean if i smell like that incense I could be charged with possession of marijuana? That hardly seems right. I'am prolly wrong considering i'm new to marijuana drug laws. just trying to get the facts Thanks

Of course it can. It can also be used as the basis of a legal search.

Do you USUALLY burn incense in your car?

I completely understand it as a basis of a search but to actually get charged with possession doesn't sit right to me. If a kid is using isopropyl alcohol to clean anything and spills and on his jacket and goes for ride gets pulled over and smells like alcohol he could get an MIP for merely smelling like the alcohol?

It 'might not sit right' but if you're charged, then you have to defend yourself. And we're not talking isopropyl alcohol here. The OP stated that they were lighting a 'second bowl' when they were surrounded.

Rubbing alcohol is a completely different smell than marijuana, and LEO's are highly trained and can definitely distinguish the difference between the two.

Take a sniff of nail polish remover then one of beer or grain alcohol; smell the difference? You betcha!

alright bad example. a sixteen year old kid in his car reeks of cigarettes because his mom a chain smoker was just in the car, he gets pulled over and the officer then searches him and whatever. the kid could get a minor in possesion of tobacco because he smells like the cigarettes?
