Target Wrongly Acused Me of Shoplifting
My question involves criminal law for the state of: texas
I went to Target to return a merchandise, while I talk to the customer service lady she told me that I make a nice deal on a piece of beddin couse the real price now went up again so i decided to keep it and ask her if i can go ahead in the store with the thing i decided to keep and she told me yes. so i went in the store and start putting inside a Target red bag all the thing i was going to purshase. after some time my baby goy hungry and i told my daugther to take him to the food area and buy him something to eat and take the shopping car with the items i already was going to change. I went to the electronics to get some new converter boxes paid for them in the back of the store and continue my walk to the fron where my kids where waitinh for me. I place the bag in the shopping car and took my baby and seat him on the car and i start walking out the store before i walk out i was by the store alarm the lady stopped me and told me to go in the back of thr store i went and she ask accused me of shoplifting. I told her and explained her that my intension was not to steal anything that i have the money to pay for averything i just have tha shopping car full and forgot and start walking i did not went outside the store. I expained her several times because now they have all king of bag in the stores to place your merchandise because of the cost in the enviroment. well she called the police and because i was my first offense i have a court day. i will like to know if i hired an lawyer can i win a lawsuit agains the store. or please advise me in this case i have to go to court next week. or first should i wait for whats going to happen at court and then talk about suit. please answer me asap my babies where crying and very concern about what happens. By the way to be more specific i have the receipt for the other merchandise and also i made the lady call the customer service lady who told me i can walk inside the store with the other merchandise and she admit that i have that merchandise with me and the receipts for except for the ones i did not paid and really was that i forgot my intension never was to steal anything i show the lady that i have the money to pay for everything but she just call the police and when the police came he asked me do you want to pay for the items and i told him yes and she told me that they dont work like that and procecured me.thanks

For what? You did not purchase the merchandise you were walking out of the store with. That is stealing. The store did nothing wrong, you did.

Everybody uses that excuse "I have the money". You are the one that did not return to the customer service desk to exchange the merchandise. You headed for the door. and why would you make the statement about having the money at all? You supposedly were exchanging merchandise you brought into the store. What an odd statement to make when you actually did not intend on purchasing the merchandise with new money but rather using the money from your returned items.
Oh wait, you had the merchandise you were returning AND the stolen merchandise? Apparently the Target you shop at is different than the hundreds of other Targets where you do not carry the purchased merchandise you are exchanging around the store with you. You leave it at the service counter and bring up the new merchandise. Actually, unless you were exchanging for like merchandise (wrong size or defective) a refund is typically issued and yousimply purchase whatever you want with the money you recieve.
Your Target must be a bit differerent that the others.
If you disagree with what has transpired, hire an attorney to defend you but you surely are not going to win any sort of suit against Target for this situation.

You did attempt to steal whether it was intentional or accidental. What you need now is an Attorney

Does this story wash with the being allowed to carry the merchandise being returned through the store? or at least unsealed?

I did not work Target but I can tell you no retailer in its right mind would allow that so yes you are correct it doesnt wash

Really? you want to sue? Wow you leave with unpaid for merchandise and they are in the wrong? Sorry but this "mistake or accident" is going to cost you the same as if it was on purpuse. Good luck

Yes, aparently this target let me carry the things I have to exchange or already purshase into the store and I ask the customer service person if i can go ahead and go in the store with the merchandise and she said yes, also i was putting the things that i was going to buy in those new bags that you buy at the store for the waist of paper or the enviroment thing I have my car full with the 2 comforters and a portable dvd box that i previously purshased and then i went and buy more elctronics and have the receipt for everything except for that red target bag. like i said before my intention was not to steal anything i am an honest person and never have any problems like this before. thanks

You cannot prove your intent! If Target can prove you walked out of store with unpaid for merchandise your dead in the water

Yes, and you simple "forgot" to pay for the merchandise you were walking out the door with.
I am over 1/2 century old and I have never "forgotten" to pay for something and walk out the door. I suggest the judge won;t believe you either. I doubt he has forgotten to pay for a BIG RED BAG FULL OF merchandise setting in full view of the person pushing the cart.
Just so you are aware, even placing the items in bags at all is enough to get you charged with theft in many states. It shows intent as it is a means of concealing the merchandise.
Additionally, this entire situation sounds like a pre-planned method of stealing. "Here kiddo, take the baby (with the cart with the unpaid for merchandise in it which just happens to already be in a bag) to the food area (which just happens to be beyond the cash registers) and wait for me while I pay for a few things and make it look like I figured you had already paid for that merchandise (IN THE BIG RED BAG) while I was paying for this other stuff. We will then walk out the door and it will all be ours".
Maybe not your intent but very easy to see it that way.
